Section 230 of the Communications Decency Act made it absurdly easy for anyone to use the internet to libel your good name or attack your business brand.  The act provides immunity from liability for providers of an "interactive computer service" who publish information provided by others. That means that if I put up a website that publishes third party articles (like a press release site, for instance), anyone can publish an article that is full of lies about you and/or your business--and you have NO recourse against me as the site owner. I am immune from your protests—unless you get a court order against the original publisher or writer.

Recent Case Study

Denver Web Services was approached by an attorney who had a high-profile client (HPC) who was being attacked and libeled on the internet by a disgruntled former business associate (FBA). The attorney had been struggling for months, to no avail, to get the libelous materials removed from the internet via traditional legal routes. The attorney did not have an operational grasp of the internet or reputation management and prudently requested assistance from us.

We were contacted in early August, 2010 by the HPC’s attorney. We immediately assessed the situation--and provided a reputation management strategy designed to rectify the problem.

The FBA was writing, producing, and publishing various articles, blogs, and videos to the web that were defamatory and libelous. But they were being posted to 3rd party websites which were under no obligation (because a court order had not yet been issued) to remove such materials, even though they were clearly defamatory and damaging to the HPC. The defamatory materials mentioned the HPC, his spouse, and a friend by name, and when their names were searched via Google or Bing, the negative materials were ranking high and very prominently.

For unknown reasons, the decision to launch the campaign was delayed until November. During this delay, the number of negative, defamatory results continued to increase in the search results.

Once we were turned loose on the project, however, our assignment was to eliminate all negative search results from the first three pages (or 30 results) for all Google and Bing searches related to the HPC,  his spouse, and their friend’s various names (8 names in total).

While a six-month campaign and strategy was proposed (and is sometimes required), in this particular case--less than 90 days later the campaign was essentially completed and transitioned into a monitoring and maintenance mode. Please see the chart below which shows the history and progression of our campaign to eliminate the negative search results returned in the first 30 search results of Google for each name searched.
